Real Estate - Residential and Commercial
Whether you are buying or selling real estate, the process can be stressful and emotional. When you buy or sell your home or other real property in New York, you need a lawyer. The first step is reviewing the contract. When you are buying, the title or history of the property must be examined to make sure there are no liens or other negative problems and if there are to make sure they are resolved on or before closing. When you are selling property, documents must be prepared, information gathered and issues resolved before closing.
A commercial transaction is more complicated due to possible zoning issues, mortgage financing, structure of the purchasing entity and other issues.
A real estate transaction may be relatively straight forward, but it can also get complicated quickly. You need an experienced lawyer to handle your real estate needs.
As an examining attorney for Chicago Title Insurance Company, Scott can write title insurance for your real estate transaction. Title insurance rates are set by the New York State Insurance Department and can be found at www.ratecalculator.fnf.com.
Civil Trial Practice
When you get sued, you need someone who has been in court his whole career. Whether it's federal or state, New York or Pennsylvania, trial or appellate courts, Scott has been there.
Some of the types of cases Scott has handled include: breach of contract, quiet title actions (ownership of property), easement and boundary line disputes, guardianship proceedings, declaratory judgment, injunction, evictions, mortgage foreclosures, collections, employment (discrimination, contracts), construction, commercial, municipal (zoning and planning).
Lawyers are trained to take both sides of a dispute so they are able to sue and defend.
Wills and Estates
Everyone should have a will, health care proxy and power of attorney.
When a person does not have a power of attorney, a guardianship proceeding may be necessary to designate someone to act for them.
When someone dies, a will tells the family how the person wanted to distribute their estate assets. If you do not have a will, the state law sets out who gets what from the person's estate.
If a person dies with assets still in their name, a probate proceeding may be necessary.
Business and Corporate
When starting a business (LLC, Corporation, Partnership, or Sole Proprietor), setting up the proper form is important.
Representing business involves many issues from contract review, drafting and interpretation to employment law.
Being able to handle commercial real estate, general business matters and litigation, gives Scott an advantage over most business practitioners.
Municipal
As the Town Attorney for the Town of Elmira since 2002, Scott has handled many municipal issues that come up in local government.
Scott regularly attends Planning and Zoning Board meetings, which have allowed him to gain valuable experience in representing both municipalities and parties that appear before these boards.
Having litigated for and against municipalities gives Scott a leg up in handling most local government matters.
